TERMS AND CONDITIONS\r\n\r\nGENERAL CONDITIONS\r\n\r\nSubject\r\nThese General Terms and Conditions of Contract (GTC) govern the remote sale and, as far as compatible and not otherwise derogated, the non-remote sale of tickets, passes, or other titles necessary for the use of the services displayed on the Site, carried out by CED Digital on behalf of the organizers of the aforementioned services.\r\n\r\nDefinitions\r\nThe following definitions apply to these GTC, it being understood that the definitions in the plural will apply to the corresponding singular term and vice versa:\r\n\r\nRome & Vatican City Card Application or APP: refers to the mobile applications attributable to CED Digital that allow the purchase of Access Titles.\r\n\r\nConsumer Code: refers to Legislative Decree 6 September 2005, no. 206.\r\n\r\nConsumer: refers to the Customer who is a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity that may be carried out.\r\n\r\nSales Contract: refers to the contract concluded, as a result of CED Digital Services, between the Customer and the Organizer and which has as its object the sale of the Access Title, governed by these GTC and the information provided on the Site, before the conclusion of the contract, also pursuant to and for the purposes of Articles 49 et seq. of the Consumer Code.\r\n\r\nCustomer: refers to the subject who, as a result of CED Digital Services, purchases the Access Title from the Organizer.\r\n\r\nContract: refers collectively to the CED Digital Services Contract and the Sales Contract.\r\n\r\nMain Service: refers to the service to which the Holder of the Access Title has the right to access.\r\n\r\nOrganizer: refers to the subject organizing the Service, on behalf of whom CED Digital acts:\r\n\r\nOmnia Card and Rome Pass: Opera Romana Pellegrinaggi, based in Palazzo del Vicariato Vecchio “Maffei Marescotti”, extraterritorial area SCV, located in Via della Pigna n. ° 13/a, 00186 Rome\r\n\r\nHolder of the Access Title: refers to the subject who legitimately holds and in accordance with these General Terms and Conditions of Contract an Access Title purchased by the Customer.\r\n\r\nCED Digital Sales Points: refers to the sales network affiliated with CED Digital.\r\n\r\nSite: refers to the site romevacticancard.com, managed by CED Digital.\r\n\r\nCED Digital: refers to CED Digital & Servizi S.r.l., with registered office in Via Barberini 28 – 00187 Rome (Italy); tel. +39 06 45412200 email marketing[@]cedsdigital.it, which acts on behalf of the Organizer within the Sales Contract.\r\n\r\nAccess Title: refers to the document, also in digital format, issued by the Organizer or by CED Digital on behalf of the organizer, which legitimizes the Holder of the Access Title to use the Services.\r\n\r\nCED Digital Services: refers to the services provided by CED Digital through the Site, concerning the reservation of the Access Title, delivery, or other forms of making the Access Title available to the Customer, as well as additional ancillary services related to the sale of the Access Title, if requested by the Customer, but excluding, in any case, the provision of the corresponding Main Service, which is the exclusive competence and responsibility of the Organizer.\r\n\r\nScope of application\r\n3.1 The sale on the Site of Access Titles constitutes a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of the Consumer Code and Legislative Decree 9 April 2003, no. 70, containing the regulation of electronic commerce.\r\n\r\n3.2 These GTC may be modified at any time. Any changes will be effective from the moment of their publication on the Site in the \"Terms and Conditions of Purchase\" section, present in the footer of each page of the Site. Users are therefore invited to consult, before making any purchase, the most updated version of the GTC.\r\n\r\n3.3 The applicable GTC are those in force on the date of transmission of the purchase order of an Access Title. Before proceeding with the conclusion of the Contract, the user is required to carefully read all the information that CED Digital provides on the Site, both before and during the purchase procedure, and to examine and approve these GTC, by selecting the appropriate box made available to the user during the purchase procedure and before the conclusion of the Contract.\r\n\r\nPurchases on the Site\r\n4.1 To purchase Access Titles on the Site, registration or access through third-party accounts, if available on the Site, is required. Purchase is allowed both to users who qualify as Consumers and to users who do not qualify as such. For natural persons, purchase is allowed only if they are at least 18 years old.\r\n\r\n4.2 CED Digital reserves the right to refuse or cancel orders from users who have provided false, invented, fantasy, incomplete, or otherwise incorrect identification data.\r\n\r\nSite Registration\r\n5.1 To register on the Site and create the related account, the user must fill out the appropriate form, entering their personal data as required, as well as an email address and a password.\r\n\r\n5.2 The user guarantees that the personal data provided to CED Digital, during the registration procedure on the Site or at any other time, are complete, truthful, and refer to the user themselves. Each user can have only one registration on the Site. CED Digital reserves the right to close multiple accounts attributable to the same person, physical and/or legal, and/or the same company and/or entity.\r\n\r\n5.3 The registration credentials (email address and password) can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them. They also undertake to immediately inform CED Digital, by contacting it at the contacts indicated in the \"Contacts\" section of the Site, in case they suspect or become aware of improper use or undue disclosure of the same.\r\n\r\nInformation for the conclusion of the contract\r\n6.1 In accordance with Legislative Decree 9 April 2003, no. 70 concerning electronic commerce, CED Digital informs the user that:\r\n\r\na) to conclude the purchase contract of an Access Title on the Site, the user must fill out an order form in electronic format and transmit it to CED Digital, electronically, following the instructions that will appear from time to time on the Site;\r\nb) if provided, the order form must be sent within the maximum time indicated on the Site;\r\nc) the contract is concluded when the order form reaches the CED Digital server;\r\nd) before proceeding with the transmission of the order form, the user can identify and correct any data entry errors by following the instructions present on the Site in the different stages of the purchase;\r\ne) once the order form is registered, CED Digital will send the Customer, to the email address indicated, the order confirmation containing: the essential information relating to the Access Title purchased, the detailed indication of the price, delivery costs, and any additional costs, the delivery term as well as the information relating to the Customer Service contacts to which the user can turn for assistance and/or to make complaints. The order confirmation email, which contains a link to the GTC, constitutes the confirmation of the contract concluded on a durable medium pursuant to Article 51, paragraph 7, Consumer Code; the Customer acknowledges and recognizes that, once this email is sent, CED Digital has fulfilled its documentation obligations and that, therefore, the Customer is bound by the Contract and is, in particular, required to pay the Total Amount, regardless of the receipt of the order confirmation email, which depends on third parties and/or factors that are outside the control of CED Digital (e.g., the email provider used by the user);\r\nf) the order form will be stored in the CED Digital database for the time necessary for its execution and, in any case, within the terms of the law. The user can access the order form and/or the data related to it through their personal account.\r\n6.2 The languages available to users for the conclusion of the contract are Italian and English. Customer Service is able to communicate with users in the same language.\r\n\r\nAvailability of Access Titles\r\n7.1 The package of Access Titles that can be purchased through the Site is determined by the Organizer, who establishes the number, price, and type of Access Titles to be put on sale on the Site, also establishing any limits on the number of Titles that can be purchased.\r\n\r\nInformation on Access Titles and reservations\r\n8.1 The categories of Access Titles related to each Main Service are described on the Site. The use of Access Titles is subject to specific terms and conditions, established by the Organizer. Users are recommended to review the rules of use of individual Main Services on the Organizers' websites and in the \"Information\" section of the Site, which form an integral part of this Contract.\r\n\r\n8.2 CED Digital, not constituting an exclusive distribution network nor the subject managing the sales decisions related to a specific Main Service, is not responsible for the type of services put on sale by the Organizer.\r\n\r\n8.3 The use of Main Services may be subject to mandatory reservation. The reservation is managed independently by the Organizers and CED Digital has no responsibility regarding the related process, although links to the pages where reservations can be made may be present on the Site, solely to facilitate the Customer.\r\n\r\nPrice of Access Titles\r\n9.1 The Price of Access Titles is set by the Organizer and includes any presale rights set and applied by the Organizer itself.\r\n\r\n9.2 The Price of Access Titles indicated on the Site is the last price communicated to CED Digital by the Organizer. The Organizer reserves the right to change the Price of Access Titles at any time, provided that in the case of purchase through the Site, the price that will be charged to the user will be the one indicated on the Site and that any subsequent changes (neither increase nor decrease) after the transmission of the order will not be taken into account. In particular, any lower price that is applied by the Organizer to Access Titles of the same type or with regard to Main Services to be held on a particular date after the purchase by the Customer will not entitle the Customer to a refund of the difference.\r\n\r\n9.3 Prices are expressed in Euros and should be considered inclusive of VAT, where applicable.\r\n\r\nPurchase orders\r\n10.1 The effects of the Contract are conditional on the payment of the Total Amount. If such payment does not occur, the contract will be considered not concluded or terminated by law. The user will be immediately notified of this termination and the consequent cancellation of the order, immediately after the transmission of the order, through the Site.\r\n\r\n10.2 The ownership of the Access Titles will be transferred to the user at the time of the conclusion of the Contract. In the case of home delivery and/or collection at CED Digital Sales Points, the risk of loss or damage to the Access Titles, for reasons not attributable to CED Digital, will be transferred to the user when the user or a third party designated by them and different from the carrier, materially takes possession of the Access Titles. 10.3 To send an order relating to an Access Title through the Site, the user must carefully read and approve, by selecting the appropriate box made available to them during the purchase procedure, these GTC.\r\n\r\nPayment methods\r\n11.1 The payment of Access Titles purchased through the Site can be made using the payment methods indicated on the Site. CED Digital reserves the right to apply, for security reasons, limitations and exclusions to the payment instruments that can be used by the Customer for the payment of Access Titles. In case of termination of the Sales Contract and in any other case of refund, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; if this is not possible, the refund will be made by bank transfer. CED Digital will ask the Customer for the bank details necessary to make the refund.\r\n\r\n11.2 CED Digital uses a secure payment service that involves the use of the SSL security protocol. The confidential credit card data is encrypted and thus transmitted to the payment manager. CED Digital therefore never has access to and does not store the credit card data used by the user for the payment of Access Titles.\r\n\r\nMethods of collection and delivery of Access Titles\r\n12.1 The delivery of Access Titles purchased on the Site can be made in the following ways: (i) delivery to the postal address indicated in the purchase procedure (\"Home Delivery\") and (ii) delivery through immediate printing of the Access Title (\"Immediate Printing\"). The alternative or cumulative availability of the aforementioned delivery methods is not guaranteed.\r\n\r\n12.2 In the case of Home Delivery, the Access Titles purchased on the Site will be sent and delivered to the postal address indicated by the user in the \"Address\" phase of the purchase procedure.\r\n\r\n12.3. At the time of shipment, an email will be sent to the Customer confirming the carrier's acceptance, which will also contain the shipping code/tracking number by clicking on which the Customer can check the status of the shipment.\r\n\r\n12.4 Home Delivery is subject to a fee and, unless otherwise provided, delivery costs are borne by the Customer. The amount of delivery costs due by the user in relation to a specific order is expressly and separately indicated (in Euros and inclusive of VAT) during the purchase procedure, in the Cart, in the Order Summary, and, in any case, before the user proceeds with the transmission of the order and payment.\r\n\r\n12.5 In case of non-delivery due to the absence of the recipient, the courier will leave a notice to document the delivery attempt. The notice will also contain the contact details where the user can collect the Access Titles. After the failed delivery attempt, the Access Titles will be stored by the courier. The user is required to collect them within the term indicated by the Courier. If the user does not collect the Access Titles within this term, the Access Titles will be returned to CED Digital, where they will remain available to the Customer who, if desired, can request a new Home Delivery from CED Digital, subject to payment of the related costs. In no case will the non-acceptance of the delivery of Access Titles result in the termination of the Contract.\r\n\r\n12.6 Delivery terms start from the date of conclusion of the Contract (i.e., the sending of the order), unless otherwise indicated. The delivery term of the specific order will also be indicated in the order confirmation. In case of failure to indicate the delivery term, it will occur, in any case, within thirty days from the date of conclusion of the Contract.\r\n\r\n12.7 If the Access Titles purchased are not delivered or are delivered late compared to the delivery terms indicated during the purchase procedure and in the order confirmation, the Customer can report the problem to CED Digital, by contacting it at the contacts indicated in the \"Contacts\" section of the Site. CED Digital will respond to the report within 5 days of receiving it. The Customer, moreover, pursuant to Article 61 of the Consumer Code, can invite CED Digital to make the delivery within an additional appropriate term to the circumstances (\"Additional Term pursuant to Article 61, III paragraph, Consumer Code\"). If this additional term expires without the Access Titles being delivered to them, the user is entitled to terminate the contract and is entitled to a full refund, which will occur within 15 working days from the day of termination of the Contract, in the manner indicated in Article 11 above.\r\n\r\n12.8 If the package containing the Access Titles is damaged, the Customer must indicate the anomalies present on the carrier's transport document, accepting the package with reservation and notifying CED Digital. Receipt without reservation of the Access Titles does not allow for any damages to be claimed. 12.12 CED Digital may also make available to the user the delivery through Immediate Printing, which allows the Customer to immediately print the Access Titles purchased with the help of a normal printer. The user is reminded that, in any case, to use the \"Immediate Printing\" delivery method, the user must use a PC on which the \"Adobe Acrobat Reader\" program is installed and updated.\r\n\r\n12.10 The Organizer's access control system will authorize the entry of only one Access Title equivalent to a single barcode. Any photocopies and/or fraud resulting from improper use of the same will be prosecuted according to the law. The Organizer will not allow access to any duplicated Access Titles under any circumstances.\r\n\r\nRight of withdrawal and cancellations\r\n13.1 CED Digital informs that the right of withdrawal is excluded for leisure services that the Organizer undertakes to provide on a specific date or period, pursuant to Article 59, I paragraph, letter n) of the Consumer Code. For passenger transport services, withdrawal is also excluded by Article 47 letter m) of the Consumer Code.\r\n\r\n13.2 Notwithstanding the above, for the following Access Titles: Omnia Card 24 hours and Omnia Card 72 hours, the right of withdrawal is allowed if the user is a consumer, provided that the reservation of the Main Service has not yet been made. Withdrawal can be exercised within 14 days from the date of delivery of the Access Title.\r\n\r\n13.3 Withdrawal can be exercised by sending a communication to one of the following contacts: email support[@]romevaticancard.com, registered mail CED Digital & Servizi S.r.l. Via del Tritone 152 – 00187 Rome (RM), specifying Romevaticancard.com on the outer envelope, pec CEDDIGITALESERVIZISRL[@]LEGALMAIL.IT.\r\n\r\n13.4 In case of withdrawal, the refund will occur within 15 days from the receipt of the communication, in the same manner used for payment. CED Digital reserves the right to request the return of the Access Title at the user's expense.\r\n\r\n13.5 Unless otherwise indicated on the Site, the cancellation of booked Main Services does not entitle to a refund. Any rescheduling of the reservation is at the discretion of the Organizer.\r\n\r\nAccess Titles and Main Services\r\n14.1 All Holders of Access Titles must have a valid Access Title to use the Main Services.\r\n\r\n14.2 The Access Title constitutes a title to use exclusively the Main Service for which it was issued, on the day and time of the reservation, if made. The Organizer has the right to refuse access to the Main Service if the Access Title is irregular and can carry out checks on the person for security reasons. If it is found that the Access Title has been stolen, duplicated, or obtained in violation of these GTC and/or the law, the Holder of the Access Title may not be authorized by the Organizer to use the Main Service or may be required to leave it. In any case, CED Digital will not replace the Access Title in the event that it is lost, misplaced, deteriorated, damaged, or destroyed, or if the Access Title has been stolen or is even partially illegible as presented by the Customer not perfectly intact.\r\n\r\n14.3 CED Digital may at any time cancel, at the request of the Organizer and/or the authorities responsible for the protection of public order and safety, for technical and/or organizational reasons other than those referred to in Article 15 below, an already issued Access Title or a purchase order relating to an already made Access Title. In such a case, the Customer will be entitled to a refund of the amount paid, excluding Home Delivery costs, if the shipment of the Access Title has already taken place at the time of cancellation of the order and/or Access Title.\r\n\r\n14.4 CED Digital is in no way responsible for the correct performance of the services to be provided by the Organizer, necessary for the use of the Access Title.\r\n\r\nMain Service postponed or canceled\r\n15.1 CED Digital is not, in any case, responsible for any cancellation or suspension of the Main Service by the Organizer. In case of cancellation or suspension of the Main Service by the Organizer, CED Digital will communicate to the Customer, on behalf of the Organizer, the initiatives adopted by the Organizer in relation to the refund or replacement of Access Titles related to the postponed or canceled Main Service. The Customer is reminded that the Organizer, in case of cancellation of the Main Service, reserves the right to retain any presale rights and that, even in this case, CED Digital is completely unrelated to the Organizer's decisions.\r\n\r\n15.2 In case of suspension or cancellation of the Main Service by the Organizer, in no case can the Customer request a refund of Home Delivery costs from CED Digital, if incurred.\r\n\r\n15.3 In case of cancellation or suspension of the Main Service, CED Digital will proceed with the refund to the Customer, according to the methods and timing decided by the Organizer, only if CED Digital has been specifically delegated to such refund and to the extent that it has received the necessary provision from the latter. In any case of cancellation and/or postponement of the Main Service, the Customer can still contact the Organizer to assert all their rights against them.\r\n\r\nLimitations of liability and rights of CED Digital\r\n16.1 Except in cases of willful misconduct or gross negligence, CED Digital cannot be held liable for expenses and damages, direct and indirect, of any nature, suffered by the Customer in relation to the sale of Access Titles.\r\n\r\n16.2 CED Digital reserves the right to withdraw, modify, suspend, or interrupt any function or service provided by it in relation to the sale of Access Titles, where this is necessary or appropriate for technical and/or organizational reasons, without prejudice to the fulfillment of the Contract already concluded.\r\n\r\nProhibitions\r\n17.1 Access Titles cannot be resold for a fee in the context of the professional conduct of commercial activities, even if not organized in the form of a business, without the express consent of the Organizer and in any case if the Organizer specifically prohibits the transfer of ownership based on principles of nominative.\r\n\r\n17.2 Access Titles, moreover, cannot constitute the prize of prize events, whether or not falling within the scope of application of DPR 430/2001, nor of other prize or promotional initiatives (such as, by way of example, competitions or lotteries), except in the case of prior written authorization issued by the Organizer or by CED Digital, if authorized by the Organizer. The Customer declares that they will not use the Access Titles in violation of this provision and undertakes to keep CED Digital indemnified and held harmless from any damage that may result from the violation of this guarantee.\r\n\r\nAssistance and Complaints\r\n18.1 It is possible to request information, send communications, or submit complaints by contacting CED Digital's customer service at the contacts indicated in the \"Contacts\" section of the Site.\r\n\r\nPersonal data\r\n19.1 CED Digital will be the data controller of the Customers' personal data. This data includes the name and contact details indicated by the Customer at the time of registration. The data will be processed according to what is indicated in the Privacy Policy available at the link romevaticancard.com/privacy-e-cookies.\r\n\r\n19.2 If the Contract concerns nominative titles or services, the Customer's personal data will be transmitted to the Organizer, who will process them as an independent data controller.\r\n\r\nApplicable Law and Competent Court\r\n20.1 The Contract relating to CED Digital Services is subject to Italian law.\r\n\r\n20.2 It is recalled that in the case of a Consumer user, for any dispute relating to the application, execution, and interpretation of these GTC or the Contract, the court of the place where the user resides or has elected domicile is competent.\r\n\r\n20.3 In any case, the rights of Consumer users to apply to the ordinary judge competent for the dispute arising from the Contract, and, where applicable, to promote an out-of-court resolution of disputes relating to consumer relations through the procedures referred to in Articles 141 et seq. of the Consumer Code, are reserved.\r\n\r\n20.4 For non-Consumer users, any dispute is devolved to the exclusive jurisdiction of the court of Rome.\r\n\r\n20.5 The services of which Opera Romana Pellegrinaggi is the Organizer may be subject to the laws of Vatican City.\r\n\r\n\r\n————————————————————————————————————————————————\r\n\r\nFor specific acceptance of the following clauses: 13.1 (cases of exclusion of withdrawal), 13.5 (cancellations), 15 (postponements or cancellations), 16 (limitations of liability), 20.4 (competent court), 20.5 (applicable laws).
