- INDEMNITY AND LIABILITY
- All tours booked are at your own risk. Bikes ‘n Wines shall not be liable for any loss, damage, injury, death, additional cost, accident, delayor irregularity experienced by you regardless of how it arose, even in such instance of an error, negligence, act or omission by Bikes‘n Wines, its employees or agents in carrying out the arrangements of the tour, or otherwise in connection with the tour. You shall have no claim of whatsoever nature or kind against Bikes ‘n Wines.
- You hereby indemnify and holdharmless Bikes ‘n Wines, its employees and agents from and against anycosts, liability, loss, injury, damage, penalty, fine, settle mentor expense (including but not limited to fines, damages awarded, costs of mitigating damages) or any other claims of whatsoever nature or kind made by any third parties whatsoever arising out of this agreement.
- Under no circumstances shall Bikes ‘n Wines be liable for any indirect or consequential damages, or special damagesarising out of or relating to its rendering of services or failure to render those services.
- RAINY DAY POLICY
- We’d love to think we can control all the elements of a tour, but unfortunately rain and bad weather is not one of them.
- We have a policy in place to ensure that you, our valued guests, get the most out of a rainy day tour with us.
- On the day of the scheduled tour, Bikes ‘n Wines will solely make the decision regarding the suitability of the weather conditions for the tour. The decision will be communicated to you as soon as possible. We take the below approach, when it comes to touring on a rainy day:
- Cycle in the rain if you are happy to do so. If you are not happy to cycle in the rain, then you need to follow step 2 or 3 below.
- Do the tour by vehicle if it’s raining too hard, and only if you are happy to do a vehicle driven tour. If you do not want a vehicle driven tour, then you need to follow step 3 below.
- Reschedule the tour to an alternative convenient date for you subject to Bikes ‘n Wines availability. Only if you are unable to reschedule the tour to an alternative date, will a full refund of the tour fee be applicable.
- Someone from our office will be in touch with you via phone, text or email on the morning of the tour to confirm the days plan and activity.
- Please feel free to get in touch with us should you have any concerns about the above.
- USE OF PHOTOGRAPHIC AND VIDEO IMAGES
- You consent to Bikes ‘n Wines using photographs and video footage from the bike tours for marketing related purposes.
- COVID19 CANCELLATIONS
- If your trip is cancelled due to COVID you will be entitled to 95% of your fee back (this is simply less banking fees) or the option for a 12-month voucher on your booked tour.
- The company retains the right to enquire about the authenticity of the cancellation (positive COVID test or notice of flight cancellation/border closures before effecting any refunds
