BOOKINGS AND CANCELLATION POLICY

All booking requests (either online bookings or bookings in person) are confirmed upon receipt of payment. When Cape Town Kayaks receives your payment, an automated email will generated confirming your booking. Please contact us immediately should you not receive the confirmation email.

Prices are subject to change without notice.

Once your booking request is received, invoiced and full payment made, it is refundable as per the conditions below:

(a) Less than 48hrs before scheduled tour = No refund

(b) Less than 72hrs before scheduled tour = 50% refund

(c) More than 72hrs before scheduled tour = 90% refund

(d) Cape Town Kayaks shall refund 95% of the tour fee for all tours cancelled due to inclement weather*

*This decision shall be made by solely by Cape Town Kayaks on the day of the scheduled tour and communicated to you as soon as possible. Please refer to “Rainy Day Policy” below. Should you choose to cancel the day tour for any other reason, conditions (a) – (c) above will apply.

PERSONAL INFORMATION

Cape Town Kayaks collects certain personal information from you either whilst you browse our website while deciding which tour is you or gathering information required for bookings (your contact details, form of identification and other info we need to confirm your booking). We keep and treat all personal information in accordance with the relevant provisions of the Protection of Personal Information Act4 of 2013.

All personal information collected by us is kept in a safe place and not used for any other purpose than that for which it was originally collected. If you have any questions about any personal information collected or in our possession, you can contact us at any time.

INDEMNITY AND LIABILITY

All tours booked are at your own risk. Bikes ‘n Wines shall not be liable for any loss, damage, injury, death, additional cost, accident, delay or irregularity experienced by you regardless of how it arose, even in such instance of an error, negligence, act or omission by Cape Town Kayaks, its employees or agents in carrying out the arrangements of the tour, or otherwise in connection with the tour. You shall have no claim of whatsoever nature or kind against Cape Town Kayaks.

You hereby indemnify and hold harmless Cape Town Kayaks, its employees and agents from and against any costs, liability, loss, injury, damage, penalty, fine, settle mentor expense (including but not limited to fines, damages awarded, costs of mitigating damages) or any other claims of whatsoever nature or kind made by any third parties whatsoever arising out of this agreement.

Under no circumstances shall Bikes ‘n Wines be liable for any indirect or consequential damages, or special damages arising out of or relating to its rendering of services or failure to render those services.

RAINY DAY POLICY

We’d love to think we can control all the elements of a tour, but unfortunately rain and bad weather is not one of them.

We have a policy in place to ensure that you, our valued guests, get the most out of a rainy day tour with us.

On the day of the scheduled tour, Cape Town Kayaks will solely make the decision regarding the suitability of the weather conditions for the tour. The decision will be communicated to you as soon as possible. We take the below approach, when it comes to kayaking on a bad weather day:

1. Paddle only within the shelter of the Hout Bay harbour.

2. Reschedule the tour to a later time-slot, taking our availability into account.

3. Reschedule the tour to an alternative date, taking our availability into account.

4. If none of the above are suitable solutions, then a full refund will be applicable, and shall reflect as a credit on your account.

Someone from our office will be in touch with the client via phone, text or email on the morning of the tour to confirm the day's plan and activity.

USE OF PHOTOGRAPHIC AND VIDEO IMAGES

You consent to Cape Town Kayaks using photographs and video footage from the kayak tours for marketing related purposes.

COVID19 CANCELLATIONS

If your trip is cancelled due to COVID you will be entitled to 95% of your fee back (this is simply less banking fees) or the option for a 12-month voucher on your booked tour.

The company retains the right to enquire about the authenticity of the cancellation (positive COVID test or notice of flight cancellation/border closures before effecting any refunds

Using our website or making payment of the booking fee constitutes an acceptance by you of these terms and conditions.

Minimum age is 6 years. A minimum of 2 people is required to confirm a tour.  Single travellers enquire about adding on to pre-booked tours. Not wheelchair accessible. Subject to favourable weather conditions.
